Terms of Service

These Terms govern your use of the Fenzly application and related services (“Fenzly”), operated by Logil Sàrl (“we”, “us”), [registered address], Switzerland.
1. Acceptance
By creating an account or using Fenzly, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Fenzly.
2. Eligibility
You must be at least 13 years old to use Fenzly. If you are under the age of digital consent in your country (which can be up to 16 in parts of the EU), you may only use Fenzly with the consent and under the supervision of a parent or legal guardian. By using the service you confirm that you meet these requirements.
Fenzly offers a guardian-managed family mode: a child uses Fenzly as a “child” member of a family circle, designated with a guardian’s verifiable parental consent; the guardian keeps dedicated controls (allowed contacts, sharing, account deletion).
3. The service
Fenzly lets you share your location and related information with people you choose, using end-to-end encryption. We may update, add, or remove features over time. The service is provided on an ongoing basis but may evolve.
4. Trial, plans and payment
Fenzly is used under a license. A free trial is included when you create your account; beyond it, full use of the service requires a paid plan (the current plans and prices are shown in the app). Subscriptions are purchased through Apple’s App Store or Google Play: billing, automatic renewal, cancellation and any refunds are handled by the relevant store, under its own terms.
Some plans include several licenses that you can assign to members of your circles; an assigned license can be withdrawn at any time, in which case the person concerned benefits from a short grace period. When a subscription lapses without renewal, the account switches to spectator mode: sharing stops, but your account and local data are preserved.
5. Your account
Fenzly is passwordless: access to your account relies on your device and on the verified channel (email address or phone number) that receives your one-time sign-in codes. You are responsible for keeping that device and that channel secure, and for activity under your account. Provide accurate information when registering, and keep it up to date. Because of our encryption design, we cannot recover your data if you lose access to your account and your backup — keep your recovery material safe.
6. Acceptable use
You agree not to:
- use Fenzly to track or monitor any person without their informed consent;
- use the service for any unlawful, harmful, harassing, or abusive purpose;
- attempt to break, overload, or circumvent the security of the service;
- use Fenzly to infringe the rights of others.
Sharing another person’s location without their consent may be illegal in your jurisdiction and is strictly prohibited.
7. Location sharing and consent
Fenzly is built on consent: location and place sharing require the agreement of the people involved, and invitations must be accepted. You are solely responsible for ensuring you have the right to share any information you choose to share.
8. Emergency feature (SOS)
Fenzly offers an SOS alert designed to notify your close ones. It is provided on a best-effort basis: its delivery depends on the network, the devices and their settings, and cannot be guaranteed. Fenzly is not an emergency service and is in no way a substitute for calling official emergency services (112, 911, or the numbers in force in your country). In an emergency, always contact emergency services first.
9. Intellectual property
Fenzly, its software, design, and trademarks are owned by Logil Sàrl. These Terms do not grant you any ownership; you receive a limited, personal, non-transferable right to use the app for its intended purpose.
10. Privacy
Your use of Fenzly is also governed by our Privacy Policy, which explains what data we process and how we protect it.
11. Security and “as is” nature of encryption
Fenzly implements the Signal protocol using a pure-Dart library. While this provides strong end-to-end encryption, it has not undergone an independent third-party cryptographic audit. We describe our security honestly and make no representation that the encryption is “certified” or “audited”.
12. Disclaimer of warranties
To the extent permitted by law, Fenzly is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of location data, or uninterrupted availability.
13. Limitation of liability
To the extent permitted by law, Logil Sàrl shall not be liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, Fenzly. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Suspension and termination
You may stop using Fenzly at any time and delete your account from the app or from fenzly.app/delete-account; deletion is immediate and permanent (see the Privacy Policy). Deleting a child account requires a guardian’s approval. We may suspend or terminate access if you breach these Terms or use the service in a way that harms others or the service itself.
15. Changes
We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance.
16. Governing law and jurisdiction
These Terms are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, subject to any mandatory consumer-protection rules that apply to you.
